Agency
This is a MUST READ topic for all buyers. People with many experiences as buyers of real estate have been surprised by what they learn.
Buyer Agency is the highest level of representation offered to a Buyer by a real estate professional. A Buyer Agent is required to represent your interests, as long as those interests are legal. The Listing Agents represent the Seller of a property. In negotiating price and terms, the Seller’s Agent represents their interests. Unless you have entered into a Buyer Agency Agreement with your Agent, your interests may not be represented. Georgia Law prohibits a Broker from representing a Buyer as a client without first entering into a written Agreement with that Buyer. Georgia law requires a written and signed Buyer Agency Agreement for an Agent to represent you.
By entering into a Buyer Agency relationship with your Agent, you will be given a higher level of service. Your Buyer Agent will analyze information such as comparative market data, advise you on negotiating and wording the Purchase and Sale Agreement, and, in general, act as your advocate in the purchase process.
In about 99% of all residential real estate transactions, the Seller pays all commissions and the Buyer receives the full benefit of professional representation. Your Buyer’s Agent will address the possible cost and any other questions you may have at the time you are presented the Buyer Agency Agreement. In the Agreement, you consent to handle all real estate inquiries, questions, information requests, showing and concerns through your Buyer’s Agent. In return, you will have a much less stressful home buying experience!
If you decline Buyer Agency, you will not have a representative to look out for your best interests. In fact, your Agent may be required by law to represent the interests of the Seller. For the most part, Buyers without a Buyer Agent simply have not been informed that they have the right to be represented. As the Buyer, you make the decision whether to be represented or not.
